My post is solely about how silly the judges statement was and how his track record on guns made this an obvious decision from him.
It was an obvious decision based on the precedents of Miller and Heller.

He also undermined the likely 9th Circuits application of Intermediate scrunity, which shouldn't even be appropriate for a fundemental right like this.

The State made a piss poor case of establishing a compelling state interest, arguing that they prefer people defending themselves to be less accurate, in addition to relying on a raft of dubious statistics.

The 9th will likely slap it down because they're the 9th, but he anticipated and addressed most likely counter arguments.

If Miller isn't still good law, then his ruling can largely be undercut. I don't know what the general consensus on Miller is, and was hoping GH could enlighten us. Heller seems to rely on Miller, with the new standard that weapons in common use cannot be prohibited, as opposed to the ruling in Miller that uncommon weapons without Militia utility can be banned.

… but probably would’ve added to the victim count. It’s just a hobby for most of those good guys with guns.

Cops have a much worse track record than permitted carriers when it comes to shooting bystanders. I see this trope a lot, but examples of joe gun owner returning fire and hitting the wrong person seem incredibly rare. Much of that has to do with the typical scenarios being different, of course.

In the 2012 Empire State building shooting, two cops managed to injure 9 bystanders in the process of shooting one armed suspect. Their New York trigger might have contributed, but they were something like 20 feet behind the guy and managed to miss with a significant number of their shots.

The more I've read about the Miller ruling I don't understand how the idea that one would need to be a militia member in order to own guns isn't a thing.

The other day driving by the apartments near Lowe's I saw a guy and a lady placing a shotgun in the trunk of their car. Probably nothing, but I did have one of those "did that just happen?" moments and then went about my day.
