It's almost as if black lives don't even matter! People should be protesting!
Everything's perfectly all right now. We're fine. We're all fine here, now, thank you. How are you?

It’s not a gotcha. I agree with him. He’s asking the right question.simple schoolboy wrote:How is this a gotcha? For the sake of racial justice, he should have just plead guilty so as to get fucked as badly as others that were less lucky?McParadigm wrote:"If they did this to me, imagine what they could've done to a person of color who doesn't maybe have the resources I do, or [if] it's not widely publicized like my case."

Its a shame we squandered the moment to try to address these issues.McParadigm wrote:It’s not a gotcha. I agree with him. He’s asking the right question.simple schoolboy wrote:How is this a gotcha? Prosecutorial immunity is a tricky question, I'm not sure how to address that. Steep sanctions for Brady violations?

I don't understand where people got the idea that he was counterprotesting the BLM event. He was non confrontational the entire time. Sure, he wanted to see the excitement, but his only message was anti-fire and anti-boo-boo. Is BLM pro arson or something?VinylGuy wrote:Im sure he spent all that time in jail because he is a BLM supporterB wrote:Oh! He said that? I didn't realize he said that! Re: America..why won't you just ban the fucking gun?
What was the prosecution's theory of the crime? That the McMichael's brandished at him so he was justified in attempting to defend himself and they had a duty to retreat if they wanted to re-establish self defense?
The other elements, following him in a truck, open carry, etc were not criminal acts.
Murder for the driver seems ridiculous, unless the discussion was, "That guy tresspassed, we're going to hold him at gunpoint until the cops come, even if he's fleeing".
If they reasonably believed he had commited a felony, would they have been justified in brandishing? (Seems like felony was not necessarily a reasonable belief)
I could be mistaken, but if the difference between reasonably believing Arbery commited a misdemeanor (their acts were murder) vs reasonably believing Arbery commited a felony (their acts were completely legal) seems rather strange.

The punchline, of course, being that multiple prosecutors decided not to charge these men, one of said prosecutors was later indicted for obstruction in the matter, and no action was taken for 74 days….until video surfaced and produced public outrage.BurtReynolds wrote:Just imagine, they would have gotten off if arbery were black.

Re: America..why won't you just ban the fucking gun?
Georgia's citizen arrest law (now repealed) arguably applied. The original prosecutor is going to get off because of prosecutorial discretion. There was some questionable stuff about getting special treatment because they knew the sheriff, of course.McParadigm wrote:The punchline, of course, being that multiple prosecutors decided not to charge these men, one of said prosecutors was later indicted for obstruction in the matter, and no action was taken for 74 days….until video surfaced and produced public outrage.BurtReynolds wrote:Just imagine, they would have gotten off if arbery were black.

So they didn’t just go ahead charge them even without sufficient evidence?McParadigm wrote:The punchline, of course, being that multiple prosecutors decided not to charge these men, one of said prosecutors was later indicted for obstruction in the matter, and no action was taken for 74 days….until video surfaced and produced public outrage.BurtReynolds wrote:Just imagine, they would have gotten off if arbery were black.

Man that sucks that they waited for video evidence to surface. What a racist country.

If you a schlubby, probably racist white guy, and a black man gets shot, thats murder. Thats how it works.Bi_3 wrote:So they didn’t just go ahead charge them even without sufficient evidence?McParadigm wrote:The punchline, of course, being that multiple prosecutors decided not to charge these men, one of said prosecutors was later indicted for obstruction in the matter, and no action was taken for 74 days….until video surfaced and produced public outrage.BurtReynolds wrote:Just imagine, they would have gotten off if arbery were black.

Re: America..why won't you just ban the fucking gun?
I was mistaken, seems like the Georgia citizen's arrest law allowed for misdemeanor citizen's arrest if you witness that misdemeanor. Felony citizen's arrest only required probable cause. Sounds like a good reason to have repealed it.
The judge may have made an error in the jury instruction for that law, so there is grounds for an appeal.
If the McMichael's observed a misdemeanor they were allowed to perform a citizen's arrest.
What we now know is that its not worth confronting someone over your neighbor's attractive nuisance, and going forward you need to have a better reason than a misdemeanor to try to perform a ctizen's arrest in Georgia.
