there is something there yeah, specially with both of them actually being persecuted when it never happened before. I consider them to be very different but there is something there for sure.

A New York firm that helps defend people against these specific charges describe it this way on their client-facing site…
Simply, if you delete, alter or make a false entry in the business records of an enterprise and you do so with the intent to defraud, you have run afoul of the misdemeanor crime. If when you do so, you also have the intent to further or conceal another criminal offense, then you have committed the felony crime.
So I guess my expectation is that the answer to your question is found in the headline “indicted on 34 felony counts.”

The degree to which that assumption on my part proves incorrect will, I suppose, be known soon enough.

In New York, falsifying business records can amount to a crime, albeit a misdemeanor. To elevate the crime to a felony charge, Mr. Bragg’s prosecutors must show that Mr. Trump’s “intent to defraud” included an intent to commit or conceal a second crime.

In this case, that second crime could be a violation of election law. While hush money is not inherently illegal, the prosecutors could argue that the $130,000 payout effectively became an improper donation to Mr. Trump’s campaign, under the theory that it benefited his candidacy because it silenced Ms. Daniels.
Which is where the question comes from... because another crime would need to be added, "conspiracy", to elevate the business fraud to felonies.

My overall take is that this is relatively minor, but if you do enough shady things in life over the course of 70+ years on this planet, shit's bound to catch up to you.

He gave Cohen the hush money, it violated the campaign donation cap, they conspired to claim it as payment for legal fees, and conspired to report it as income for Cohen. I feel like I’m missing something else in there, but that’s enough for felony charges.
