I looked it up. I am not a lawyer, but to me it reads like it is legal to park in a handicapped spot even if you don't get out of the car. But this is because law enforcement simply have no way of knowing the person's intentions. If they knew they were never intending on getting out the car, there would probably be some sort of bad intentions enforcement à la Minority Report. So, I think both sides of this debate have a fair point.

I just looked at CA, IL, AL, FL, GA, NY, and MT to see what their laws say. In each one, there is a sentence that states that in order to use accessible parking, you must:

Have the license plate with the wheelchair logo on it, or have a CURRENT placard with the wheelchair logo AND
The person with the license plate or placard leaves the vehicle.
The laws are not all worded the same way, but the substantive intent is clear: the placard/plate is only valid when the person to whom it was issued leaves the vehicle. If that person decides not to enter the store, then the driver must change to a regular spot.

The placard/plate is only for the use of the person for whom it was issued in order to accommodate their disability. If the disabled person stays in the car, their disability requires no accommodation.

We don't have handicap spots because, "oh, your life is hard, here's a good parking space!" We have them because people with disabilities can't participate in society without them. If they were just an award for having lived a difficult life, we could give everyone with a disabilities a bunch of candy.

He's not using the spot to accommodate his disability, and he's blocking the spot from someone who may need it. It's an easy call.

dad, its not being a vigilante or policing. its using common sense. if the guy had gotten out of the car to get his daughter he is 100% using the handicapped space for the intended use. however he is parking there and not getting out for his daughter who is fully capable of walking and has no known handicap.

should it be legal for anyone to park in a handicapped spot and only get a ticket if someone with a handicap plaque/sticker actually tries to park in the spot that is taken by a handi-capable person?
