hopefully he gets DQ'ed based on constitutional amendment 14 in the meantime

how would that be applied

certain states take him off the ballot?

guess none of the red states would

but maybe with a concerted effort and independent judiciary (and a pile of special interest money) in some purple states, we can rig the election to exclude him enforce the constitution to ensure only candidates who qualify are on the ballot

well, according to the two conservative legal scholars that published the argument, conviction is not necessary, just that you engaged in, or gave aid or comfort to those enemies
The clause states that "no person shall be a senator or representative in Congress, or elector of president and vice president, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."
so my guess is that, since Trump made it a habit of publicly declaring things that appear to be providing support or comfort to the insurrectionists, that some law-loving Americans will go to a court in a given state and say: 'hey, look at this part of the 14th amendment, and look at all these tweets' and try to get him DQ'ed in that state

but maybe a state court just needs to rule that he provided comfort to the insurrectionists based on their view of his statements and is DQ’ed from their state

without him having to have been convicted of participating in or organizing one
