EAGLE COUNTY — Phillip White is blind and has been since he was 11 years old. White, who is 80 now, was just trying to get back to Eagle from a conference in Denver, where he was learning how technology can help the visually impaired.
He and his attorneys, Mari Newman and Darold Killmer, said that during an encounter, Denver police officer Kyllion Chafin slammed White’s head against a counter in a Greyhound station, opening a gash in his forehead, and handcuffed him so tightly it may have caused permanent nerve damage in his hands and wrists.
That, they said, is an excessive use of force against an elderly blind man.
A jury agreed and awarded White $100,000 for his injuries and another $300,000 in punitive damages. The judge also ordered Denver to pay court costs and White’s attorney fees.
“The punitive damages are designed to send a message not only to this officer but to police everywhere that this sort of treatment will not be tolerated in a civilized community,” Newman said.

White, at 5-feet 2-inches and 140 pounds, blind and 77 years old at the time of the incident, is nothing like an intimidating or threatening figure, Newman said.

WHAT HAPPENED
On May 22, 2012, White was in a downtown Denver Greyhound bus station, trying to take a catch a 12:15 p.m. bus to Vail. From there, he could catch a van back to his home in Eagle.
The Greyhound was sold out, so the ticket cashier told him to stick around, in case there were no-shows. The station manager also told White he could wait in the station, according to White’s lawsuit.
It’s unclear what happened that caused a Greyhound security guard to tell White he was trespassing and call Denver police, but he did.
When Chafin arrived, White asked if he could touch his badge, to confirm that Chafin was who he said he was.
“He had almost been robbed once by a person impersonating a police officer,” Newman said.
Touching the officer’s badge is how he determines whether it’s legitimate or whether he’s being conned by an impostor, Newman said.
“There’s no legitimate reason for a police officer to refuse such a reasonable request,” Newman said.
White was on his phone talking with a 911 operator through all of this.
The officer insisted that White hang up the phone, and that made him even more nervous, Newman said.
The police came in ready to make an arrest, Newman said.
“Instead of treating this almost 80-year-old man with some respect, he immediately transformed what should have been a conversation with an elderly disabled gentlemen into an excessive use of force,” Newman said.
The officer handcuffed White so tightly that his wrists were injured and his hands went numb, causing what may have been permanent nerve damage, Newman said.
Then he slammed White’s head into a counter, opening a gash in his forehead.
White was taken outside and police sat him down on the ground, where a police sergeant tried to secretly interrogate him, Newman said.
“While this elderly blind man with overly tight handcuffs was sitting on the floor with blood running down his face, a sergeant showed up and interrogated him, trying to get him to justify their excessive use of force,” Newman said.
“Can you imagine this?” Newman said. “Mr. White was saying his hands were going numb, but instead of taking care of him, the sergeant starts a secret video interrogation.”
On the video you can hear White ask the sergeant, “Can I feel your …?”
The sergeant cut him off, saying, “No, you cannot feel my badge.”
AFTER MIDNIGHT
White was taken to jail where he was held until after midnight. He was released at 1 a.m. into one of Denver’s more unseemly areas.
“Denver released an elderly blind man onto Colfax Avenue, at 1 in the morning,” Newman said.
Police alleged various crimes, charges the District Attorney immediately dismissed “because they were patently ridiculous,” Newman said.
White went to the hospital the first thing the next day.
White and his attorneys filed their lawsuit in federal court, asking for a jury trial.
The trial lasted five days last week, including a day and a half for the jury to come back with a ruling at 5 p.m. last Friday that Chafin used excessive force, and ordered Denver to pay damages.
“What happened to Mr. White is horrible, but what is even more horrible is Denver police’s insistence that they did nothing wrong,” Newman said.
The Denver police department told the media that Chafin did not violate any department policy.
“We respect the court and we respect the jury’s decision,” said Sonny Jackson, a police spokesman. “We reviewed the case. We didn’t find any violations of policy. We are always looking for ways to improve.”
In 2008, Chafin was commended by the police department for his role in preventing an armed man from committing suicide.
Denver’s defense was a combination of trying to insist they did not cause White’s injuries, and that he is not blind, Newman said.
“They continued to insist that Mr. White isn’t blind which shows they were willing to say anything to avoid accountability,” Newman said. “It was a remarkable exercise in denying responsibility.”
BLINDED AS A CHILD
White was rendered blind at 11 years old, when he was hit in the eye with an ice ball during a snowball fight with other kids.
Throughout the years, his other eye completely lost its function due to sympathetic response. Medical treatments to restore sight in his damaged eye all failed.
White earned his master’s degree in education from Michigan State University by using study materials in Braille.
White spent 33 years in education in Michigan and Oregon before he retired to Colorado.
He has hiked and climbed Colorado 14ers and he used to cross-country ski, among his many other activities, Newman said.N

That Monday, throngs of people, among them Gov. Bruce Rauner, gathered for the funeral and mileslong procession for the fallen officer.
But that mournful pride has for many been replaced with a bitter feeling of betrayal since authorities announced Wednesday they now believe Gliniewicz — widely known in the village near the Wisconsin state line — staged his suicide to look like a murder to cover up criminal activity.
Not long after the announcement, some of the placards outside the police station honoring Gliniewicz as a hero had been defaced with words including "lied, stole, disgraced."
Maureen Kelly, who manages the local bar Club G&S, said she was so angry seeing the blue ribbons and signs honoring Gliniewicz as she drove through town that she took hers down from the bar window.
Then she thought better of it, wrote "Embarrassment!!! Low-life scumbag" and "good riddance" on the sign and put it back up.
"You feel embarrassed because you believed it," she said.
Kelly recalled seeing the officer every Wednesday when he stopped in a nearby barbershop. No one in town had a bad word to say about him, she said.
"Everybody, honestly, believed the hype," she said.
Perhaps nowhere was the sense of betrayal more acute than among the members of the local Explorer post, which Gliniewicz ran for years, mentoring young people and teaching them about police work. Now authorities believe Gliniewicz had been stealing money from the group.

"Most of them are interested in becoming police officers — good police officers. And to have their mentor go off the path is going to be crushing to them.
"Joe Gliniewicz was a fantastic mentor to those kids," Ashbacher continued. "Now we all feel betrayed in a big way."
She wants the Explorers to carry on "with pride" but is worried about how to protect them from the fallout.
Ashbacher planned what she would tell her son when he came home from school. "I am going to talk to him today about the positive things he learned and that even heroes are human and have faults," she said.

"We do have some general fiscal policies that they are supposed to follow, (including) having two signatures on a check," he said. "But they don't all do it and we don't always know it."
He was surprised to hear the new developments announced Wednesday.
"We were hoping to use the legacy of that post to help grow law enforcement Exploring because all the news to this point had been positive," Hale said.
Shawn McGee, 44, who lives near the Gliniewicz family's home in Antioch, said the officer's theft from the Explorers program was the most unsettling allegation against the officer, who authorities said had engaged in "extensive criminal acts."
"He was a good guy, everyone thought," McGee said.
At Club G&S, Kelly stood behind the bar Wednesday afternoon, talking about the case with four patrons.
They agreed they thought investigators were right to take their time announcing their findings, even if it was difficult to wait for answers.
Some said they felt taken for having stood to honor him at the long procession after his funeral. Kelly said she told herself she'd mostly been honoring the other officers who came to show support.
The group debated whether it affected their view of other officers in the department, with Jamie Mockus, of Ingleside, questioning the lack of oversight.

Van Dyke, 37, who has been on paid desk duty since the October 2014 incident, is scheduled to appear for a bond hearing at noon Tuesday at the Leighton Criminal Court Building at 26th Street and California Avenue, the sources said.
The case would mark the first time a Chicago cop has been charged with first-degree murder for an on-duty fatality in nearly 35 years. Van Dyke would face a minimum of 20 years in prison if convicted of the first-degree murder charge.
Federal authorities continue to investigate whether Van Dyke violated McDonald's civil rights protecting him from excessive force by the police. A federal grand jury has heard testimony from dozens of witnesses over the course of several months.
A judge has ordered that the potentially inflammatory video be made public by Wednesday. The city lost a court fight last week to keep the video under wraps when the judge ruled in favor of a freelance journalist who sued under the state's open records law.

Lawyers for McDonald's family, who won a $5 million settlement from the city even before filing a lawsuit, have said Van Dyke emptied his Smith & Wesson 9 mm semi-automatic handgun. None of the five other officers at the scene fired a shot, according to city officials.
McDonald's autopsy found he was shot once on each side of his chest and suffered single bullet wounds to the scalp and neck, two to his back, seven in his arms, one to his right hand and two to his right leg. According to the report, nine of the 16 entrance wounds had a downward or slightly downward trajectory.
The Tribune in April first revealed that Van Dyke was the officer who shot and killed McDonald after city officials refused to disclose his identity, citing a provision in the union contract that bars the city from identifying officers unless they're convicted of a crime or the police board rules on their case. Police stripped him of his police powers and put him on paid desk duty pending the outcome of the investigation.
According to police and court records, Van Dyke joined the department in 2001 and spent more than four years with a specialized unit — since disbanded by police Superintendent Garry McCarthy — that aggressively went into neighborhoods experiencing spikes in violent crimes.

Watched it back a few times just now. Just horrible. I noticed how the cop behind the shooter almost jumped back when shots were fired, almost like he was surprised. I would expect McCarthy is going to be the fall guy here. Also pretty grossed out by Rahm paying off the family 5 million but stating he hadn't seen the tape. Does he really think anyone is stupid enough to believe that?

Yeah the amount of deception and lying in this case by Rahm, McCarthy, D.A Alvarez, the police force for deleting security footage from Burger King, the Independent Police Review Authority finding nothing wrong is just staggering. It also business as usual....
