RIP Antonin Scalia

Wow, this is a game changer. Even right now, there would be a lot of contentious cases currently before the Court that would probably end up affirming the lower court by an equally divided Court.

You think Obama can push through such a stealth candidate through the GOP Senate?

Why not nominate himself and let Biden serve out the rest of his term?
Spoiler: show
Nowhere close to possible, of course.

Watching my wife's face as I told her the news was hilarious.

Hell, if I were president, I'd probably try to do this, especially if my VP is running to succeed me.

You should find a GIF that emulates her reaction.

Gonna look for a gif of the moment George found out Susan died on Seinfeld.

I need to look at the list of important cases closer, but if this happened on Fisher vs. UT and Whole Woman’s Health v. Hellerstedt, it would mean that in the 5th Circuit, affirmative action would survive & there would be much stricter abortion restrictions.

Dear lord, the next year's going to be even uglier between the White House and Senate, if such a thing is possible.

Someone who knows more than me: could there be any way for the Senate to delay a replacement until next spring? Have we ever gone an entire calendar year with 8 judges?

This is why each Justice should have one 18-year term that alternates every two years so that death and aging don't decide this. I'm trying to put my game theory hat on to see if this circumstance could provide the perfect storm necessary to actually amend the Constitution to do this.

Absolutely. The Court can run alright with 8 justices, you'll just have a few "affirmed by an equally divided Court" rulings that will reach the Court a year or two later after the ninth Justice is filled. The stakes are too high for the GOP to not be obstructionist.

I'm kind of surprised that no Republican lawmakers have tweeted their intentions to do so already.

I knew I should have posted this in here instead. No Republican cares more about the Court than this guy.
