I believe "sex" is the relevant criteria that affords protected status. Gender and sex are distinct, at least until it becomes convenient to conflate the two.

The other problem with emphasizing that particular point is that it undercuts the administration's position. Sex and gender are distinct but sex discrimination and gender discrimination are the same thing.

I read something a few weeks ago about how the left are too 'smart' to have conversations about these things and end up talking down to everyone and pissing them off instead of actually, you know, talking. For the most part I agree, but that's because the left is arguing for things that should be readily apparent to squirrels and yet here we are, arguing, instead of just figuring out the problem.

To be fair, the right is just as bad, they just have far fewer media mouthpieces to spew their snark and so can't dominate the conversation as easily. That and they generally aren't as witty.

Both sides in America have long abandoned any pretense of working with or listening to the other. It's about crushing opposition now, which will be a bloody mess considering the country is split down the middle. The right started it I think, but the left has wholeheartedly adopted the policy and surpassed them.
