Agreed, I think both Jorge's and Lament's picks should be valid.

They're not identical scenarios, I don't think there's any great inconsistency.

Lament's pick is fine too as it was officially released in the 90s.

No, it doesn't "stick in my craw." It happens to be a situation similar to a song I was strongly considering picking which exists under fairly similar circumstances. I had been operating under the assumption that I could take it in this tournament. Obviously I can't.
