He's only on trial for 10 felonies. They were probably all cooked up by the Biden Administration for political reasons through.Bammer wrote:So this Hunter Biden guy … jail? Share a cell with Trump?
Everything's perfectly all right now. We're fine. We're all fine here, now, thank you. How are you?

Pardon his son or risk his appeal ending significant numbers of gun control laws. Quite the dilemma for Biden.

Didn't he already say he won't pardon him? I think it would be political suicide to get involved.Bi_3 wrote:Pardon his son or risk his appeal ending significant numbers of gun control laws. Quite the dilemma for Biden.

Has no one appealed this before? I doubt he's the first drug addict to buy a gun.

Pretty much everyone pleads out. The ATF will also request the DOJ drop cases if they fear an adverse outcome on appeal.B wrote:Has no one appealed this before? I doubt he's the first drug addict to buy a gun.

I don’t give two shits what happens to Hunter Biden, but I’m not clear how his inevitable appeal would impact gun control laws. Didn’t New York State Rifle & Pistol Association v. Bruen already draw a deciding line on the matter?Bi_3 wrote:Pardon his son or risk his appeal ending significant numbers of gun control laws. Quite the dilemma for Biden.

Re: The 46th POTUS - Joseph R. Biden, Jr.
I'm not putting a judgement on this at all. I'm just saying that his appeal is unlikely to impact gun laws that have already stood through previous appeals.Bammer wrote:Yes, yes … minimize minimize minimize. Re: The 46th POTUS - Joseph R. Biden, Jr.
I’m sure better analysis will appear in the next week but here from Reason:McParadigm wrote:I don’t give two shits what happens to Hunter Biden, but I’m not clear how his inevitable appeal would impact gun control laws. Didn’t New York State Rifle & Pistol Association v. Bruen already draw a deciding line on the matter?Bi_3 wrote:Pardon his son or risk his appeal ending significant numbers of gun control laws. Quite the dilemma for Biden.
“ In a motion to dismiss the gun charges, Biden's lawyers argued that Section 922(g)(3) is inconsistent with the Second Amendment. Last year in United States v. Daniels, they noted, the U.S. Court of Appeals for the 5th Circuit overturned a marijuana user's conviction under that law, rejecting the government's argument that his prosecution was "consistent with this Nation's historical tradition of firearm regulation"—the test that the U.S. Supreme Court established in the 2022 case New York State Rifle & Pistol Association v. Bruen. Several other federal courts likewise have ruled that prosecuting cannabis consumers for illegal gun possession failed the Bruen test.
U.S. District Judge Maryellen Noreika, who presided over Biden's case, rejected his pretrial motion last month, saying he had failed to show that Section 922(g)(3) is unconstitutional on its face. But she said Biden could still challenge the law as applied to him if he was convicted.”

Re: The 46th POTUS - Joseph R. Biden, Jr.
I guess I’ll have to wait for that analysis…because that doesn’t read to me like a profound showdown over gun rights is being teed up at all.
New York State Rifle & Pistol Association v. Bruen exists and has been used by multiple appeals. I don’t personally think it should exist, and I don’t think Hunter Biden should be successful in his appeal because I think gun control laws should be able to account for things like illegal drug use. But here we are.

Reading the politico link is better, it was too long for me to post here. The issue is largely about laws that prohibit nonviolent offenders from owning guns could be found unconstitutional.
