I'm confused. It sounds to me like the civil case is proceeding in a much narrower scope? Or is the decision in the article somehow separate from the civil case?
I'm sure there's someone better placed than me to summarise, but from what I gather based on that link:

- Josh successfully argued to limit the scope of the civil claim to exclude punitive damages
- the victim's family may still be awarded compensatory damages should their claim ultimately succeed
- when the civil case was commenced, Josh hadn't been charged criminally; now that he has, Josh has sought the civil case is temporarily stayed until the resolution of the criminal matter
- the civil matter is back in court next month in relation to the latter issue

The Aus/NZ leg kicks off in less than three weeks, will be interesting to see if Josh is in the touring party.
