I think maybe he meant what the students could get back if they sued the school/state?

My initial reaction was, "Even if they could sue...why would they?" It'd be like character-suicide to say, "I have every right to be racist!" (even though, obviously, they do) But based on that one kid's apology, it looks like they're suiting up for suing and will lead with: "Did you read my statement? I was willing to turn my life around and learn from this but then the school kicked me out..."

If they did sue, I think they would be encouraged by a third party to do so. The ACLU was my first thought, but they seem to be tiptoeing around this very carefully right now. Plus, the relief wouldn't likely be so much monetary as it would be to get readmittance to OU

Can these students claim that their first amendment rights were violated? Isn't OU a private university?

Most "University of [Insert State Here]" schools are public. The only one that comes to mind that isn't is Penn.
