I'm curious as to whether this will adversely affect the state's request for a stay if the alleged harm has already been done.

Judge issued a stay on the ruling, so we've reverted to the pre-ruling standard. As it stands, confiscation is still prohibited, but purchase is no longer allowed after 5pm on Friday.

The state threatened to go above the ruling judge to the 9th circuit if a stay wasn't issued. Is this a thing that a party other than a State's Attorney General can do?

So much to laugh at in this story, not the least of which being the gun nut in question's name is actually "McNutt." He really shot himself in the foot on this one.
