That's true, but the point of the accords is not to stop the avengers - it is to establish a body that can be held accountable for the detection.

Sure, but many more Avengers may have ended up on Cap's side had they argued about this. Setting Sarcovia aside b/c well, Stark made Ultron (oops!), is the governing body going to be similar at all to the one that launched the nuke on New York, or that was heavily infiltrated by Hydra in Winter Soldier or the shot the shit out Berkley trying to capture the Hulk who was not Hulking out all that often until they started attacking him?
At the very least, Black Widow wouldn't have signed up for registration.
