I think there's a good argument to make that those laws would be unconstitutional. What you'll want to keep an eye on is the balance of power in Congress, of which the Republicans currently control both houses. If they lose the Senate, of which the odds are fairly good but not yet guaranteed, they'll also be in the minority of Supreme Court appointments. But their control of the House has been rock solid in recent years thanks to gerrymandering districts in their favor.
