Apologies - I don't understand the US laws around private gun sales. No, he could've bought in a private sale as a prohibited person. Only licensed dealers can access the background check system, so in a private sale the only due diligence you can really do is check their ID. This is both a feature for those that don't want a paper trail and a bug (for those that want to screen potential buyers).
Do you have specific info that it was private sale? Only what I heard on a youtube news video this morning, apologies can't be more specific. They definitely said that of the various guns he had "most" were sourced from private sales.
