Apologies - I don't understand the US laws around private gun sales. Are you saying that if he was in some way a "prohibited person" he shouldn't be able to purchase a gun, even via private sale?

No, he could've bought in a private sale as a prohibited person. Either he chose to go the private sale route because he was a prohibited person or it's irrelevant.

Only licensed dealers can access the background check system, so in a private sale the only due diligence you can really do is check their ID. This is both a feature for those that don't want a paper trail and a bug (for those that want to screen potential buyers).

Do you have specific info that it was private sale? Building his own guns wouldn't be much more work, and similarly no paperwork.

Only what I heard on a youtube news video this morning, apologies can't be more specific. They definitely said that of the various guns he had "most" were sourced from private sales. Also that he was discharged from the army on "mental" grounds.
