Well it's not a penalty if the defender hits it out of a players hands. I think the point of the rule is to keep it so players try to get the ball that's been fumbled, not kick it or bat it downfield just so the other players can't.

i could see it either way, but i'm pretty sure the rule is in place so that you don't advance a fumble. like an offensive player fumbling it forward (intentionally) out of bounds.

I'm obviously a Dolphins fan, but I think he was trying to bat it away from the Patriots player, so I guess he did commit the penalty, but it's still a brutal call. It's totally a judgement call and it is possible that when a DL is diving for a football that really awkward things happen and maybe it looks different than what he's actually trying to do. All that said, the penalty should be something to the effect of...from the spot where the ball was batted the worst result for NE would be possession right there. IE, if Miami recovered they still wouldn't get the ball, NE would get it at the spot of the batting. But for it to be a 10 yard penalty AND an automatic 1st down, man that was a back breaker. The punishment does not fit the crime.
