I'm not sure what Mitch could do because Biden would have the House on his side, but yeah the Supreme Court would (rightly) stop anything like that from going into effect before the ink dried.

I meant that these gambits are usually an attempt to force the Senate's hand, make them take action, and I think Biden loses that stare-down.

Gotcha. Yeah I don't think McConnell is physically capable of blinking at this point, just licks his eyeballs to provide the moisture. So he has a pretty big competitive advantage in any stare-down scenario.
